[แถลงการณ์] เรียกร้องให้ผู้พิพากษาปล่อยตัวชั่วคราวนักเคลื่อนไหวทางการเมืองเพื่อยืนยันเจตจำนงค์แห่งรัฐธรรมนูญ

แถลงการณ์สมาคมนักกฎหมายสิทธิมนุษยชน 

เรียกร้องให้ผู้พิพากษาปล่อยตัวชั่วคราวนักเคลื่อนไหวทางการเมืองเพื่อยืนยันเจตจำนงค์แห่งรัฐธรรมนูญ

จากกรณีที่นักเคลื่อนไหวทางการเมืองถูกจับกุมดำเนินคดีตามความผิดตามประมวลกฎหมายอาญามาตรา 112 และมาตรา 116  และศาลมีคำสั่งไม่อนุญาตให้จำเลยหรือผู้ต้องหาได้รับการปล่อยตัวชั่วคราว ด้วยเหตุผลหลายประการ เช่น คดีมีอัตราโทษสูงเกรงว่าจะหลบหนีและเกรงว่าถ้าปล่อยตัวไปแล้วจำเลยจะไปกระทำผิดซ้ำกับความผิดที่ได้ถูกฟ้อง เป็นต้น แม้ทนายความและนักวิชาการได้พยายามยื่นคำร้องขอให้ศาลปล่อยตัวชั่วคราว รวมทั้งอุทธรณ์คำสั่งศาลที่ไม่อนุญาตให้ปล่อยตัวชั่วคราวไปหลายครั้ง แต่ศาลอาญามีคำสั่งไม่ให้ประกันตัวผู้ถูกกล่าวหา โดยให้เหตุผลว่าไม่มีเหตุให้เปลี่ยนแปลงคำสั่ง ทำให้จำเลยที่มีบทบาทในการเคลื่อนไหวทางการเมืองถูกคุมขังในระหว่างการพิจารณาคดี โดยปัจจุบันเป็นเวลากว่า 1 เดือนแล้ว และยังมีจำเลยรายอื่น ๆ ที่ทยอยถูกส่งฟ้องและศาลมีคำสั่งไม่อนุญาตให้มีการปล่อยตัวชั่วคราวเช่นเดียวกัน

วันนี้สมาคมนักกฎหมายสิทธิมนุษยชน ในฐานะองค์กรต้นสังกัดที่นายอานนท์ นำภาเป็นสมาชิก ร่วมกับศูนย์ทนายความเพื่อสิทธิมนุษยชน ในฐานะสำนักงานที่นายอานนท์ นำภาสังกัดอยู่ พร้อมกับรายชื่อทนายความจำนวน 187 คนที่ร่วมลงชื่อยื่นคำร้องขอให้ศาลพิจารณาปล่อยตัวชั่วคราวอานนท์ นำภาและจำเลยในคดีความผิดลักษณะเดียวกันอีกครั้ง เพื่อยืนยันหลักการตามรัฐธรรมนูญที่บัญญัติรับรองไว้ว่าก่อนที่จะมีคำพิพากษาจำเลยจะถูกปฏิบัติเหมือนผู้กระทำผิดไม่ได้ ประกอบกับมาตรา 107 แห่งประมวลกฎหมายวิธีพิจารณาความอาญาบัญญัติให้สิทธิผู้ต้องหาหรือจำเลยทุกคนพึงได้รับอนุญาตในการปล่อยชั่วคราวเป็นหลัก มิใช่ให้นำข้อยกเว้นมาถือเป็นปฏิบัติเป็นสรณะและใช้หลักในข้อยกเว้นนั้นละเมิดต่อสิทธิของจำเลยและเมื่อพิจารณาหลักเกณฑ์ข้อยกเว้นมิให้ปล่อยตัวชั่วคราวจำเลยหรือผู้ต้องหาตามมาตรา 108/1 พบว่า ไม่มีเหตุที่ควรเชื่อได้ว่าจำเลยจะมีพฤติการณ์ที่เข้าองค์ประกอบที่ศาลจะสามารถยกหลักข้อยกเว้นดังกล่าวมาบังคับใช้ ซึ่งข้อยกเว้นดังกล่าว คือ

(1) ผู้ต้องหา หรือ จำเลย จะหลบหนี

(2) ผู้ต้องหา หรือ จำเลย จะไปยุ่งเหยิง กับพยานหลักฐาน

(3) ผู้ต้องหา หรือ จำเลย จะไปก่อเหตุอันตรายประการอื่น

(4) ผู้ร้องขอประกัน หรือ หลักประกัน ไม่น่าเชื่อถือ

(5) การปล่อยชั่วคราว จะเป็นอุปสรรค หรือ ก่อให้เกิดความเสียหาย ต่อการสอบสวน ของเจ้าพนักงาน หรือ การดำเนินคดีในศาล

ทั้งนี้ เพื่อยืนยันหลักแห่งความศักดิ์สิทธิของกฎหมายด้วยหลักการของความเป็นนิติรัฐ ซึ่งเป็นรัฐที่จะต้องบังคับใช้กฎหมายเพื่อความเป็นธรรมให้แก่ประชาชน  สมาคมนักกฎหมายฯ ขอเรียกร้องให้ผู้พิพากษามีคำสั่งให้ปล่อยตัวชั่วคราวนายอานนท์ นำภากับเพื่อนๆ รวมถึงผู้ต้องหาหรือจำเลยในความผิดที่ถูกจับกุมหรือถูกฟ้องในความผิดลักษณะเดียวกันนี้โดยเร็ว การปล่อยตัวชั่วคราวจำเลยในระหว่างการพิจารณาคดีไม่เพียงแต่เป็นการยืนยันหลักการและเจตจำนงค์แห่งรัฐธรรมนูญในเรื่องสิทธิของจำเลยในคดีอาญาเท่านั้น แต่หมายความรวมถึงการยืนยันความกล้าหาญของศาลที่จะใช้กฎหมายเพื่อมุ่งคุ้มครองสิทธิเสรีภาพของประชาชนเป็นสำคัญ มิใช่มุ่งแต่จำกัดหรือลิดลอนสิทธิในการต่อสู้คดีอย่างเต็มที่ของจำเลย และขอเรียกร้องให้ศาลปฏิบัติหน้าที่โดยยึดมั่นในหลักความเป็นอิสระและเที่ยงธรรม ศาลต้องเป็นตราชูแห่งความยุติธรรมที่ไม่โน้มเอียงหรือสั่นคลอนต่ออิทธิพลใด เพื่อให้เป็นตราชูที่ยิ่งใหญ่และสง่างามสืบไป

Judges urged to release political activists on bail to uphold the spirit of the constitution  

 

A number of political activists have been prosecuted for allegedly violating the Penal Code’s Sections 112 and 116 and the Courts have denied them bail invoking various reasons including the high penalty and the associated flights risk and fearing that upon release, the suspects may recommit the offence as alleged, among others. Despite several attempts by attorneys and academics to apply for bail and to appeal judicial orders to deny them bail, the Criminal Court continues to disallow them bail, simply saying that there is no ground to change the existing decision. As a result, suspects involved with political activism have been remanded in custody pending the trial for over one month. Several other suspects are also faced indictment and the Courts have also denied them bail.

Today, the Human Rights Lawyers Association (HRLA), an organization to which Anon Nampha is a member and Thai Lawyers for Human Rights (TLHR) where Anon Nampha is affiliated together with a list of 187 attorneys have filed a motion pleading the Court to consider granting bail to Anon Nampha and other defendants in similar offences. This will help to uphold the spirit of the constitution which prescribes that a defendant shall not be treated as a guilty person coupled with Section 107 of the Criminal Procedure Code which prescribes that every alleged offender or defendant shall in general be provisionally released. Any exemption cannot always be invoked, and such exemptions shall not be used to deprive the right of defendants. By reviewing all the exemptions that could be invoked to prevent a provisional release of an alleged offender or a defendant according to Section 108/1, it appears that the defendants do not behave in such way that may prompt the Court invoke the following exemptions to disallow them bail.

(1) Alleged offender or defendant may abscond;

(2) Alleged offender or defendant may tamper with evidence;

(3) Alleged offender or defendant may commit other harmful acts;

(4) The applicant or his bail or security is unreliable.

(5) 5.   The provisional release would impede or imperil an official inquiry or judicial trial.

Therefore, to uphold the sanctity of law and the rule of law, it is incumbent on the state to enforce the law to uphold justice of the people. HRLA urges all judges to promptly grant bail to Anon Nampha and his colleagues including suspects or defendants previously arrested or indicted on similar offences.  The provisional release of suspects pending the trial cannot only uphold the spirit and the principle of the Constitution as far as the rights of defendants in criminal cases are concerned, it can attest to the brevity of the judiciary to use the law as a tool to principally uphold people’s rights and freedoms and to refrain from just using the law to restrict or deprive the right to fully defend oneself in the court. We also urge the Court to perform its duties while adhering to judicial independence and fairness as the Court is the scales of justice which shall not tip or lean due to any influence to stand tall as the great and graceful scales of justice.
